Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the Polarynthex website (polarynthex.com) and services. By accessing our website or engaging our training services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or services.

Description of Services

Polarynthex provides workshop-based communication training programs for business professionals, including:

  • Executive presentation skills training
  • Boardroom communication workshops
  • Stakeholder communication training
  • Business storytelling and persuasive communication courses
  • Public speaking for business contexts
  • Presentation design and visual communication training

Our services are educational workshops, not personal coaching or therapeutic services. All programs are designed for professional development in business communication contexts.

Eligibility

Our services are intended for business professionals and organizations. You must be at least 18 years old to use our services. By using our services, you represent that you meet this age requirement and have the authority to enter into these Terms.

Registration and Accounts

Some services may require registration or account creation. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information as needed
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

Payment and Fees

Training programs require payment as specified in program materials or agreements. Payment terms include:

  • Fees are due as specified in your registration or service agreement
  • Payment methods accepted include credit cards, electronic transfers, and corporate invoicing
  • All fees are in Canadian dollars unless otherwise specified
  • Applicable taxes will be added to fees as required by law
  • Late payments may incur additional charges or service suspension

Cancellation and Refund Policy

Cancellation and refund terms vary by program:

  • Cancellations made more than 30 days before program start receive full refunds
  • Cancellations 15-30 days before start receive 50% refunds
  • Cancellations less than 15 days before start are non-refundable
  • Polarynthex may cancel programs due to insufficient enrollment, with full refunds provided
  • Rescheduling may be available subject to availability and fees
  • Corporate agreements may have different cancellation terms as specified in contracts

Intellectual Property Rights

All content on our website and in our training materials, including text, graphics, logos, images, videos, and software, is the property of Polarynthex or its licensors and is protected by Canadian and international copyright laws.

You may not:

  • Reproduce, distribute, or create derivative works from our materials without written permission
  • Use our trademarks, logos, or branding without authorization
  • Remove or alter copyright notices or proprietary markings
  • Use our materials for commercial purposes without license

Training participants receive limited licenses to use provided materials for personal professional development only.

User Conduct

When using our services, you agree not to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Transmit harmful or malicious code
  • Interfere with or disrupt our services or systems
  • Collect information about other users without consent
  • Impersonate others or misrepresent affiliations
  • Engage in harassment, discrimination, or inappropriate behavior
  • Use services for unauthorized commercial purposes

Privacy and Data Protection

Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using our services, you consent to our privacy practices as described in the Privacy Policy.

Disclaimers and Limitations of Liability

To the maximum extent permitted by law, Polarynthex shall not be liable for:

  • Damages exceeding amounts paid for services

Indemnification

You agree to indemnify and hold harmless Polarynthex, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your violation of any third-party rights
  • Your conduct in connection with our services

Modifications to Services and Terms

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time. We may also update these Terms periodically. Continued use of our services after changes constitutes acceptance of modified Terms. We will provide notice of material changes through our website or email.

Termination

We may terminate or suspend your access to our services immediately, without prior notice, for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Non-payment of fees
  • Behavior that harms our business or other users

Upon termination, your right to use our services ceases immediately. Provisions that by their nature should survive termination remain in effect.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any disputes arising from these Terms or our services shall be resolved through:

  • Good faith negotiations between the parties
  • Mediation if negotiations are unsuccessful
  • Binding arbitration in Banff, Alberta, if mediation fails
  • Courts of Alberta for matters not suitable for arbitration

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. Invalid provisions shall be modified to the minimum extent necessary to make them valid and enforceable.

Entire Agreement

These Terms, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and Polarynthex regarding use of our services. They supersede all prior agreements and understandings.
